General terms of sales

The general terms of sales below govern the sales carried out by the websites https://anciellitude.com and https://anciellitude.fr.

They were upgraded on January 1st, 2018

 

Article 1 – Items

The present conditions govern the sales by Gabriel AOUN, located MARCHE PAUL BERT, 96-110 Rue des Rosiers, ALLEE 1 stands 39& 41 – 93400, Saint-Ouen, and on the websites https://anciellitude.com and https://anciellitude.fr. We are specialized in the sale of lighting, objects, new and old furniture, restored in our workshops or created primarily by our care. Details on the products are described in each associated product page. The bulbs shown in the photos are not included when they are standard types such as E27 or E14, which are readily available and easily accessible in stores. However, for all specific bulbs, they will be provided with the lamps and will already be installed in high-quality LED format (tube lamps, etc.).

Article 2 – Price

The prices of our products are indicated in euros without taxes (VAT excluded),

In case of order towards a country other than France you are de facto the importer of one or several concerned products. Customs duties or other local taxes either import duties or taxes of state may be due. These rights and naps are not in our responsability and are not in the competence of the company ruling the website : Anciellitude. They will be at your expense and under your responsibility and are a matter of your full responsibility, both in terms of statements, declarations, and payments in the competent authorities of your country. We recommend you to inquire about these aspects.

All the orders are payable in euros.

The company ruling the website : Anciellitude reserves the right to modify its prices at any time, but the product will be charged on the basis of the current price at the time of your order, subject to the availability.

Products remain the property of the company ruling the website : Anciellitude. until the complete payment of the order.

Be aware that as soon as you take up physically your ordered items, the risks of loss or damage of products are transferred to you.

The contractual information is presented in French and English (in the English version only) and will be the object of a confirmation at the time of the validation of your order.

The company ruling the website : Anciellitude reserves the right not to accept a payment, and not to confirm a order for any reason, and more particularly in case of supply problem, or in case of difficulty concerning the order.

Article 4 – validation of your order

Any confirmation of order engage your full and whole acceptation in the present general terms of sale, without exception or reserve.

All the supplied data and recorded confirmation will be worth proof of the transaction.

You declare to be aware of the present Information and consent to them.

The confirmation of order will be worth signature and acceptance of the made operations.

A summary of the information of your order will be communicated to you via the e-mail address of confirmation of your order.

Article 5 – Payment

The fact of validating your order implies for you the obligation to pay the indicated price.

The payment of your purchases is made by bank credit card thanks to the secure system: Payplug or Paypal.

The collection of direct debits from your payment is made at the time of the order.

The payment of your purchases can be also made by bank transfer. The order is taken in hand once the transfer is received. During the time of reception of the transfer articles are reserved and removed from the sale for the benefit of the future buyer. If the payment does not succeed, we have the right to put back one or several articles on sale.

Article 6 – Retraction

According to the provisions of the article L.221-28 of the Code of the Consumption, you have no return right or refund.

EXCEPTIONS IN the RIGHT TO WITHDRAW

According to the article L.121-21-8 of the Code of the Consumption, the right to withdraw does not apply in:

The supply of the goods made according to the specifications of the consumer or clearly personalized.

Our products are clearly personalized, as they are refurbished to match at best to what the buyer ordered, that is to say : the finished version of a product.

Article 7 – Availability

Our products are proposed as long as they are visible on websites https: // anciellitude.com and https: // anciellitude.fr and while stocks last. Our products photos are not contractual. Indeed we propose on our website only products which we have in reasonable quantities not to launch a too long process of on-line publishing for a too singular product. From then our photos present objects that are part of a batch, the other objects of the same batch may have their own details of wear. Those differences which do not appears inevitably on photos, are understandable because it is about furniture, lamps and objects that had their own time and have already served mostly in industrial factory’s ! However we commit the same working quality to the restoration on each of our products to make them the most attractive possible following our known criteria of finishes. So objects presented in photo on the website are representative objects compare to the batch from which they belong but cannot be strictly identical each one another.

In case of unavailability of products due to an error of stock after signing of your order, we shall inform you about it by e-mail. Your order will automatically be cancelled and no banking flow will be made.

Article 8 – Shipment

Products are shipped to the shipping address indicated during the process of order, for an average deadline of 6 days. (Between 1 days and 15 working days approximatively) The price of the shipment includes the packing, and are calculated after considering the weight and volume of it.

In case of delay of expedition, an e-mail will be sent to you to inform you about a possible consequence over the delivery deadline which was indicated to you.
According to legal requirements, in case of delay in delivery, you benefit from the possibility of cancelling the order in the conditions and the modalities defined in the article L 138-2 of the Code of the Consumption. If meanwhile you receive the product we shall proceed to its refund after rerouting of this one in the conditions of the article L 138-3 of the Code of the Consumption.

In case of deliveries by a carrier, the company ruling the website : Anciellitude cannot be held responsible for delay in delivery owed exclusively to an unavailability of the customer.

Article 9 – Guaranteed

All the complaints have to be made by e-mail and will be answered between 1 to 6 days after reception of the email.

The purchaser is definitely responsible for the costs of transport or any other return shipping fees.

The measures of this Article prevent you from the right to withdraw as written in the article 6.

Article 10 – Responsibility

The proposed products are in accordance with the current French legislation. The company ruling the website : Anciellitude could not be committed in case of failure to respect the legislation of the country where the product is delivered. It is up to you to verify with the local authorities the possibilities of import or use of products or services which you intend to order.

Besides, the company ruling the website : Anciellitude could not be held responsible for damage resulting from a misuse of the bought product.

Finally the responsibility of the company ruling the website : Anciellitude could not be committed for all the inconveniences or damage inherent to the use of the Internet network, in particular a break of service, or outside intrusion or the presence of computer viruses.

Article 11 – applicable right in case of dispute

The language of the present contract is originally in French and the present terms of sale are submitted to the French law. In case of dispute, the French courts will be the only competent ones.

Article 12 – Intellectual property

All the elements of websites https: // anciellitude.com and https: // to anciellitude.fr are and remain the intellectual and exclusive property of the company ruling the website : Anciellitude. Nobody is authorized even partially to reproduce, to exploit, to rerun, or to use in any case, elements of the website that they are software, visual or sound. Any simple link or by hypertext is strictly forbidden without an agreement written deliberately by the company ruling the website : Anciellitude

Article 13 – Personal data

the company ruling the website : Anciellitude reserves the right to collect the name specific information and the personal data concerning it’s clients. They are necessary for the management of the orders (invoices, ect…), as well as for the improvement of the services and the information which we send to you.

They can be also passed on to the companies which contribute to these relations, such as those in charge of the execution of the services, the orders, and the delivery, for their management, execution, treatment and payment.

This information and data are also kept for purposes of safety, to respect the legal and statutory obligations. Your information can’t be sold for purposes of canvassing.

According to the law of January 6th, 1978, you have a right of access, rectification and opposition to the name specific information and to the personal data concerning you, directly on the website.

Article 14 – Archiving proof

The company ruling the website : Anciellitude will archive order forms and invoices on a reliable and sustainable support constituting a faithful copy according to the article 1348 of the French Civil code.
